Your landlord can’t kick you out of your Berlin apartment during COVID19

Good news – tenants don’t have to fear eviction if they fall into arrears between April and September 2020. The Berlin Senate is set to introduce new protective measures.

A breath of fresh air amid all the uncertainty. A. new bill will prevent landlords from evicting tenants with rental arrears between April and September 2020. This period could be extended until 31.07.2021 if necessary, as announced by the Federal Justice and Consumer Protection Ministry.

It is important to consider that this protection is for arrears accrued between 01.04.2020 and 31.07.2020, and the arrears must have been accrued as a result of the Corona pandemic. If arrears already existed before then, the landlord would still be able to exercise their right to eviction proceedings. Also, tenants who are able to pay their rent must continue to do despite the new bill. Evictions for rental arrears that are not settled will take place once the term of these protective measures ends.

All the same, it’s a sliver of hope for those who fear losing their homes in this unprecedented catastrophe.
